PATENT ELIGIBILITY, PTAB PROCEEDINGS, AND TIPS FROM THE BENCH

 

8:45 -9:00 AM -- INTRODUCTION

MORNING PROGRAM – PATENT ELIGIBILITY ISSUES

9:00 -10:30 AM –Trends in recent case law interpreting the Supreme Court’s Mayo and Alice decisions. This panel discuss the ramifications of Federal Circuit and PTAB decisions on patent eligibility to determine best strategies for protecting innovations such as new diagnostic tools in the life sciences and software innovations.

10:30 -10:45 AM – Networking Break

10:45 – 12:00 PM – Hot Topics in PTAB Proceedings.  This panel will discuss amendments post Aqua Products, Inc. v. Matal, 2015-1177 (Fed. Cir., October 4, 2017)(en banc); issues regarding multiple proceedings in view of General Plastic Ind. Co., Ltd. v. Canon Kabushiki Kaisha, IPR2016-01357, Paper No. 19 (PTAB, Sept. 6, 2017), and claim construction issues in PTAB proceedings.   

12:00-1:15 PM – LUNCH AND SPEAKER (FCBA Judge)

AFTERNOON PROGRAM – RECENT DEVELOPMENTS IN PTAB PROCEEDINGS

1:15PM – 2:15 PM  Supreme Court review of PTAB proceedings:  Oil States and SAS.    This panel will discuss the expected fallout from the forthcoming Supreme Court decisions in the  Oil States and SAS cases.

2:15-2:30 PM – Networking Break

2:30-3:30 PM – A View From The Bench: Federal Circuit Judge Hughes will discuss best practices for Federal Circuit appeals, including tips on briefing and oral argument. PTAB Judge ____ will discuss best practices for PTAB proceedings, including tips on claim construction, motion practice, and oral hearings before the Board.  Both judges will answer pre-screened questions from the audience

3:30-3:45 PM  Networking Break.

3:45 -4:45 PM – Diversity in Courts, Agencies, Corporations and Law Firms.  This panel will discuss the importance of diversity at every level in the practice of law.

  • Global Series - Launched in November 2010, the Global Series explores the search for best practices in legal systems around the world.  In the on-going dialogue, sessions already include:  Berlin and Munich, Germany; Tokyo, Japan; Beijing, China; London, United Kingdom; Toronto, Canada; Seoul, South Korea; Geneva, Switzerland; and Shanghai, China.

  • Journal - Published quarterly in collaboration with George Washington University Law School, the journal includes scholarly articles and recent case summaries, keeping you informed of developments and trends in the law in Circuit community. All past journals are available to members through the website. 
  • Circuit Case Digest - A monthly publication that provides a summary of all precedential opinions of the Federal Circuit issued the preceding month. All digests are available to members through the website.
  • Pro Bono Digest - This Digest provides useful pro bono information to the Circuit community.
  • Reviewed Adjudicators Digest - A monthly update on decisions of the tribunals reviewed by the Federal Circuit.  It covers the following matters of interest:
    • Merit Systems Protection Board
    • Patent Trial and Appeal Board
    • International Trade Commission
    • Court of Federal Claims

  • Newsletter - The newsletter contains timely information including rules changes, personnel changes, hearing dates, and upcoming meetings and events of the Association.  All newsletters are available to members through the website.
  • Webcasts - Educational and Topical Webcasts – Educational nuts & bolts advocacy and subject matter areas as well as important, timely decisions such as In Re Bilski. More than a dozen webcasts are available yearly, and are searchable by subject matter.
