Summary: Federal grants and cooperative agreements make up a sizeable portion of the U.S. government’s annual discretionary spending—rivaling the amount the government spends annually on procurement contracts.  The importance of the assistance that the U.S. government provides with these agreements also is considerable and broad, ranging in objectives from scientific development and funding for key research and development projects, to foreign policy and funding of international development projects, to encouragement of domestic social programs. Procurement contracts might serve similar objectives, but grants and cooperative agreements, but their award, administration, and structure are quite different than the award, administration, and structure of procurement contracts. These differences also make grant litigation very different from procurement litigation, and the ability of recipients to seek relief from disputes or allegations of mistreatment may be considerably truncated in some circumstances. 

This webinar will address litigation and other legal considerations unique to federal grants and cooperative agreement litigators. Panelists will discuss topics such as:

1. Legal framework governing grants and cooperative agreements
2. Jurisdictional and other limits on challenges to the grants/cooperative agreement award process, as well as the extent to which agencies are obligated to act fairly in awarding these types of agreements
3. The disputes process for grants/cooperative agreements and the various avenues available (or not available) to recipients to appeal or litigate these types of disputes
4. Accountability and noncompliance concerns associated with grants/cooperative agreements and differences in how the government approaches investigations related to these types of agreements.

FCBA will seek CLE credit from applicable states for paying registrants and for members of the FCBA from within the United States (except OH, NM & PR).
