Global Series sessions, part of an on-going dialogue since 2010, address topics of global significance at a senior level of discussion. Working closely with government representatives, adjudicators, corporate leaders, litigation leaders, academics, and others in the global community, the Series responds, in real time, to emerging challenges. The on-going Series includes participants from Canada, the United Kingdom, France, Germany, Switzerland, Japan, the Republic of Korea, the United States, the People’s Republic of China, Canada, Brazil, and other countries.

This panel will address emerging issues impacting global patent prosecution strategies and portfolio management, including the impact of AI on patent prosecution, how different jurisdictions are treating AI patents, and legal developments across different jurisdictions involving subject matter eligibility, written description, and enablement, including, for example, strategies relevant to pharma and medical device patents as well as high tech and consumer electronics patents.. The panel will also explore how the emergence of the UPC, increased trade secret enforcement, increased patent enforcement in emerging markets, and the shifting US landscape for patents is impacting patent strategies.
11:00 – 11:55AM Effective Use of Patent Mediation and Arbitration: How, Where, When and Why
The Panel will be discussing various strategies for effectively using mediation and arbitration in patent enforcement and related rights enforcement (such as SEP and FRAND), the various tribunals in which such ADR can be implemented, e.g., WIPO, TRIPS, UPC (Patent Mediation Arbitration Center (PMAC), AAA and the relative pros and cons of each, and other issues in the space such as the Technology Transfer Block Exemption Regulation TTBER, and the USPTO working group regarding SEPs.

Touching on topics ranging from the patentability of inventions, to available remedies, to reciprocity in investment, this panel will explore these various initiatives and examine the impact they might have on IP and trade.
