   2. Strategic choice of litigation routes and fora in a post-UPC landscape
   3. The unitary patent system assessed: cost efficiency, accessibility for SMEs, and simplification of the European litigation landscape
   4. Cross-border patent enforcement and the implications of recent CJEU decisions for litigation strategy

11:15am – 12:10pm – National Security, Dual-Use Technologies, and IP: Pathways to Transatlantic Interoperability and Co-Production

U.S. defense and aerospace policy includes increasing transatlantic co‐production to meet demand and increase supply chain resilience. The panel examines whether “Buy American” requirements erect barriers to achieving that goal. Simultaneously, the U.S. has expressed concerns that EU defense initiatives—including the Security Action for Europe (SAFE) and the European Defense Industry Program (EDIP)—restrict market access for American companies. Emerging dual‐use technologies such as quantum computing intensify these challenges, as national security and traditional IP frameworks can constrain supply chains and impede multinational interoperability.

This panel examines how geopolitical and national security frameworks are reshaping traditional IP and trade practices, and identifies pathways toward greater interoperability and expanded transatlantic co‐production.

The SEP/FRAND adjudication landscape is evolving rapidly. This panel examines recent decisions from the UK, UPC, China, Brazil, and the United States on FRAND remedies; the interplay between competition law and patent remedies; and the jurisdictional conflicts that arise when relief granted in one forum encroaches on proceedings in another. The panel also addresses the strategic considerations companies face when enforcing or defending against SEP assertions, and the growing role of arbitration in resolving global SEP/FRAND disputes.

Cutting-edge technologies such as AI and gene therapy are testing the boundaries of patentability law worldwide. While novelty and inventive step remain foundational, non-prior art requirements—including subject matter eligibility, written description, and sufficiency of disclosure—present equally significant challenges, and in many ways face greater challenges in terms of adapting to these next-generation innovations. This panel of global experts examines how legislatures, courts, and stakeholders are responding to these pressures across jurisdictions.

11:15am – 12:10pm – The Dynamic State of International Trade, Tariffs and the Role of IP

This panel will explore aspects of the Federal Circuit’s jurisdiction regarding international trade and IP, including implications for global markets. The panel will consider aspects of trade and IP, including (1) the impact of tariffs and IP’s role, if any, in tariffs; (2) the adequacy of IP enforcement mechanisms globally, and whether global trade disputes involving IP violations may be adequately addressed through the WTO; (3) the global impact on IP and trade of violations reported under the USTR’s Special 301 Report; and (4) the impact of exemptions provided under the 2026 Technology Transfer Block Exemption Regulation (TTBER).

The panel will examine the global patent remedies landscape and consider whether and how it is changing. In many jurisdictions, injunctive relief remains readily available, while U.S. courts have historically granted it more selectively since eBay. The current U.S. administration has signaled support for expanding injunctive relief, and the UPC offers patent holders a new enforcement avenue in Europe. The panel will consider what is driving these trends—and whether outcomes depend more on the nature of the parties, the type of claims, the area of technology, or the specific jurisdiction or UPC division.

From the U.S. Defend Trade Secrets Act to the EU Trade Secrets Directive to the patchwork of regimes across other parts of world, the rules governing how companies identify, protect, and enforce trade secrets vary sharply by jurisdiction—and the stakes have never been higher. This panel examines those contrasts across five areas: identification of protectable assets; international compliance strategies; cross-border enforcement; the patent-versus-trade-secret calculus; and the unresolved challenge of protecting proprietary information in an era of generative AI.

Ireland holds a storied place in copyright history: the country is home to the Book of Kells and has produced literary giants including James Joyce, Seamus Heaney, and Maeve Binchy—and the first recorded copyright dispute allegedly arose on Irish soil. Against that backdrop, this panel examines how generative AI is reshaping copyright law and policy. Panelists will explore competing frameworks for balancing AI innovation against the rights of content creators, including whether AI systems should be permitted to train on copyrighted works and what, if any, remuneration creators should receive.
